Terms and conditions

1. Preamble

This document sets out the terms and conditions governing the purchase of the products offered via the website www.ermo.it (hereinafter the “Site”). The Site is owned by ER.MO S.p.A., with registered office at Via Bergamo 10 – 26011 Casalbuttano (CR) – Italy, VAT and tax code 00296040199, e-mail info@ermo.it, telephone +39 0374 364111 (hereinafter the “Seller”).

Use of the Site and purchase of products imply full acceptance of these terms. The Seller reserves the right to modify these Terms & Conditions at any time by publishing new versions on the Site; such modifications shall apply to orders placed after the publication date.

2. Subject of the Contract

The Site allows the online purchase of original ERMO products and accessories (hereinafter “Products”).
The main characteristics of the Products are described in the respective product data sheets. The images are for illustrative purposes only.

3. Registration on the Site

To make purchases, the user may register by creating a personal account or proceed as a guest, if allowed. During registration the user guarantees that the data provided are correct, up-to-date and truthful. The user is responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.

4. Purchase Procedure

To complete an order:

  1. select the desired Products and add them to the cart;

  2. enter the required shipping and billing details;

  3. choose the payment method and confirm the order.

By submitting the order, the user declares that they have read and fully accepted these terms.

The Seller will send an order confirmation email containing a summary of the purchased Products, the total price and shipping information.

5. Prices and Payments

All prices are expressed in Euros (€) and, unless otherwise specified, include applicable VAT. Any shipping or additional costs will be clearly indicated during the purchase process.

The following payment methods are accepted:

  • Credit or debit card (via secure gateway)

  • Bank transfer

  • Stripe or other electronic systems if enabled

Payment is handled through secure channels with SSL encryption. ER.MO S.p.A. does not store credit card payment data.

6. Shipping and Delivery

Shipments are made within Italy and to the countries indicated on the Site. Delivery times vary depending on destination and product availability; typically delivery is within 5-10 business days from order confirmation, unless otherwise communicated.

In case of delays or logistical issues, the Customer will be promptly informed. Ownership of the Products transfers to the Customer at the moment of delivery to the carrier.

7. Right of Withdrawal (Consumers Only)

If the purchaser is a consumer (a natural person acting for purposes unrelated to their professional activity), they have the right to withdraw from this contract within 14 days from receipt of the Products, without giving any reason.

To exercise the right of withdrawal the user must send written communication to info@ermo.it indicating the order number and the Products to be returned. The Products must be returned intact, unused and in their original packaging within 14 days of sending the withdrawal communication.

Return shipping costs are borne by the Customer, unless otherwise indicated. ER.MO S.p.A. will refund the amount paid (excluding initial shipping costs) within 14 days of receiving the returned Products.

The right of withdrawal does not apply to customised or clearly built-to-measure Products.

8. Statutory Warranty

All Products sold are covered by the legal warranty of conformity pursuant to Articles 128–135 of Legislative Decree 206/2005. In case of lack of conformity the Customer must inform the Seller within 2 years from delivery, and in any event within 2 months of discovering the defect.

9. Liability

ER.MO S.p.A. is not liable for damages resulting from improper use of the Products, force-majeure events or service interruptions beyond its control. The Customer is required to check the compatibility of the Products with their needs before purchase.

10. Personal Data Processing

Personal data provided during the purchase process are processed in accordance with the Privacy Policy.

11. Governing Law and Jurisdiction

These Conditions are governed by Italian law. For any disputes arising from the sales contract, the exclusive jurisdiction will be that of the Court of Cremona, unless the purchaser is a consumer, in which case the jurisdiction of the consumer’s place of residence or domicile applies.
